Privacy statement

Hawking, established at Laan van Diepenvoorde 32, 5582 LA Waalre, is responsible for the processing of personal data as described in this privacy statement.

This Privacy Statement applies to the data for which Hawking acts as data controller. Hawking also processes personal (health) data on behalf of our clients. For this data, Hawking is not the data controller. For such data, we always enter into a data processing agreement with our clients.

Personal data we process

Hawking processes your personal data because you use our services and/or because you have provided this data to us yourself. Below is an overview of the personal data we process:

  • When you contact us via our website, email, or through our support channels:
  • First and last name
  • Email address
  • Organisation and job title
  • Phone number
  • For job applications, we record the following data:
  • First and last name
  • Address details
  • Email address
  • Phone number
  • Date of birth
  • Employment history
  • When you visit our office, you will be recorded by our security cameras upon entry.

Our website and contact channels do not intend to collect data about persons under the age of 16, unless they have consent from a parent or guardian. If you believe that we have collected personal data about a minor without such consent, please contact us at info@hawking.health and we will delete this information.

Purposes and legal bases for processing personal data

Hawking processes your personal data for the following purposes:

  • To be able to call or email you when necessary to carry out our services, or because you have requested this from us;
  • To inform you of changes to our services and products;
  • To offer you the ability to create an account;
  • Hawking also processes personal data when we are legally obliged to do so, such as data required for our tax returns.

How long we retain personal data

Hawking does not retain your personal data for longer than strictly necessary to fulfil the purposes for which your data was collected. We apply the following retention periods for the following (categories of) personal data:

  • Data for following up on a contact request: 1 year after following up on regular contact requests or job applications, and 3 years after resolving or closing support requests;
  • Data included in contracts, financial documents, or other documents subject to the statutory tax retention obligation: 7 years;
  • Video recordings and stills from our security cameras: 30 days. We may retain this data for longer in the event of incidents.

Sharing personal data with third parties

Hawking shares your personal data with various third parties. With companies that process your data on our behalf, we conclude a data processing agreement to ensure the same level of security and confidentiality of your data. Hawking remains responsible for these processing activities.

We work with the following parties:

  • For the storage of documents and digital communications, we use cloud services provided by Microsoft.
  • Hawking’s administration is partly handled by Yes We Can Healthcare Group. This data is processed both within and outside the EEA. The required agreements have been made with the processor.
  • For handling our support channels, we use cloud services provided by Atlassian.
  • The video recordings made by the security cameras at our office are processed by Ring. This data is processed both within and outside the EEA. The required agreements have been made with the processor.

Cookies, or similar technologies, that we use

Hawking only uses technical, functional cookies and analytical cookies that do not infringe on your privacy. A cookie is a small text file that is stored on your computer, tablet, or smartphone upon your first visit to this website. The cookies we use are necessary for the technical functioning of the website and your ease of use. They ensure the website works properly and remember, for example, your preferred settings. They also allow us to optimise our website. You can opt out of cookies by configuring your internet browser to no longer store cookies. You can also delete all previously stored information via your browser settings.

Viewing, modifying, or deleting data

You have the right to view, correct, or delete your personal data. In addition, you have the right to withdraw any consent you may have given for data processing, or to object to the processing of your personal data by Hawking, and you have the right to data portability. This means that you can submit a request to us to send the personal data we hold about you, in a computer file, to you or another organisation named by you. You can send a request for access, correction, deletion, data transfer of your personal data, or a request to withdraw your consent or object to the processing of your personal data, to info@hawking.health. To ensure that the request for access was made by you, we ask you to send a copy of your identity document with the request. In this copy, please black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number, and Citizen Service Number (BSN). This is to protect your privacy. We will respond as soon as possible, and within four weeks, to your request. Hawking also wishes to point out that you have the option to file a complaint with the national supervisory authority, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

How we secure personal data

Hawking takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure, and unauthorised modification. Hawking is ISO 27001 and NEN 7510 certified.
